These Terms of Use (“Terms”) govern your use of the Better mobile application (the “App”) operated by Better (“we,” “our,” or “us”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
Eligibility
You must be at least 13 years old to use the App. By using the App, you confirm that you meet this requirement and are legally able to accept these Terms.Subscription and Payments
The App is offered through paid subscriptions. Subscription purchases, billing, and renewals are handled by Apple through in-app purchases and are subject to Apple’s terms.
Your subscription renews automatically unless canceled through your Apple account settings before renewal.
Except where required by applicable law, refunds are not provided for unused portions of a subscription period.License and Permitted Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use, subject to these Terms.Prohibited Conduct
You agree not to:Copy, reproduce, modify, distribute, sell, lease, or reverse engineer the App, except as permitted by law.
Use the App for unlawful purposes.
Use the App in a way that infringes third-party rights or interferes with the App’s operation.
No Separate Account
The App does not require a separate Better account. Subscription access and purchases are managed through your Apple ID.Privacy
You may choose to provide optional profile information (such as name, gender, and age) for personalization. We also use Firebase and Google Analytics for Firebase for usage analytics.
Our data practices are described in our Privacy Policy, which is incorporated into these Terms by reference.Intellectual Property
The App and all related content, including text, graphics, logos, design elements, and affirmations, are owned by or licensed to Better and protected by intellectual property laws.
You may not use our content except as expressly allowed by these Terms.Wellness Disclaimer
Better is a wellness and self-reflection app. It does not provide medical, psychiatric, psychological, or other healthcare advice, diagnosis, or treatment.
If you have mental health concerns, seek advice from a qualified healthcare professional. In an emergency, contact local emergency services immediately.Disclaimer of Warranties
To the fullest extent permitted by law, the App is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted, error-free, or secure operation of the App.
Limitation of Liability
To the fullest extent permitted by law, Better and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, profits, or goodwill, arising from or related to your use of the App.
Our total liability for any claim relating to the App will not exceed the amount you paid for the App subscription in the 12 months before the claim arose.Termination
We may suspend or terminate access to the App if you violate these Terms or if required for legal, security, or operational reasons.
You may stop using the App at any time and cancel your subscription through Apple settings.Changes to the App or Terms
We may modify the App and these Terms from time to time. If we make material changes, we will provide notice through the App or by other appropriate means.
Your continued use of the App after updated Terms take effect means you accept the updated Terms.Governing Law and Jurisdiction
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles.
Any dispute arising out of or related to these Terms or the App will be submitted to the competent courts of the Netherlands, unless mandatory law provides otherwise.Contact
